Seller agreement
These are the terms on which you sell through kwamaj. You accept them during onboarding, and we record when you did.
Draft — not yet reviewed by counsel.
This document is incomplete: passages marked in square brackets are facts the platform has not yet supplied, or questions that need a South African lawyer to answer. It is published here so it can be reviewed, not so it can be relied on.
What we are to each other
kwamaj is the merchant of record on every sale. You supply the item; we sell it. The customer's contract is with us, and they are never told who supplied their item.
You are an independent seller, not our employee or agent.
Verification before money moves
We may not pay money to somebody we have not identified. Before you can list, we verify your identity against Home Affairs and confirm your bank account belongs to you. Higher volumes require proof of address, a tax reference and, where the law requires it, second-hand goods dealer registration.
[to be confirmed by counsel] — whether a seller on this platform is a "dealer" for the purposes of the Second-Hand Goods Act 6 of 2009 is a question for counsel, and it changes what we must require from you.
Commission, escrow and the confirmation window
We deduct commission from each sale at the rate shown in your portal. The remainder is credited to your ledger.
Customer money is held by us and released to you seven days after delivery, once the customer has had a chance to check the item and has not raised a case. If they do raise one, the payout is frozen until it is resolved.
The rolling reserve
A percentage of each payout is held back for a period and then released. This covers refunds and clawbacks on sales that go wrong after you have been paid. The percentage and the hold period are shown in your portal.
Clawbacks
If a sale is refunded after you have been paid, and the reason was your failure — the item was not as described, was faulty, or never arrived — we recover the amount from your ledger or your reserve. A customer changing their mind is not your failure and is not charged to you.
Scoring and consequences
We score sellers on delivery performance, disputes upheld against them, cancellations and customer reviews. A falling score deprioritises your listings; a low score suspends or delists you. The score and what moved it are visible to you in your portal — none of it is secret.
Stolen goods
Listing a device that fails a blacklist check ends this agreement immediately, and we report it. This is not a matter on which we exercise discretion.
